Design is a form of intellectual property protection that concerns itself with the aesthetics of a product. It is solely for the protection of how the product looks like and not how it functions.
These include products such as lamps, phone cases, jewelleries, bottles, automobiles, and any other products that has a physical form, or a user interface for a software or application.
What is Hague System?
Hague System is an international filing system for designs which allows for a single application, filed in one language, with one set of fees, to be registered in multiple countries.
There are 79 member states participating in Hague system which covers 96 countries.
Are you eligible to file under Hague System?
To be eligible, you need to be one of the following:
- a national of a Contracting Party
- domiciled in a Contracting Party
- has a real and effective industrial or commercial establishment in a Contracting Party
What are the requirements?
- Filing Language: The applicant may choose between English, French, or Spanish.
- Drawings: One or more views of the design
- Payment of fees: There are three types of fees to be paid: a basic fee; a publication fee; and a standard designation fee for each contracting states where you want your design to be registered. The fees are to be paid in Swiss francs.
Some countries will require additional requirements depending on the national laws implemented.
How much to file?
Official fee: SGD 650 which includes the basic and publication fees
Designation fee: Depends on which countries you will designate your design and the level of examination being conducted in said countries. For a more accurate estimate, please let us know which countries you wish to file your design.
Service fee: SGD500 per jurisdiction
