What is an Industrial Design?
An industrial design is an exclusive right issued by a government to a designer or applicant for their/his/her article which is new, and industrially applicable. The industrial design focuses on the aesthetics of a product which may be three-dimensional or two-dimensional, and not its functional features.
What are the Benefits of Registering Industrial Design?
This exclusive right awarded by registering for a industrial design covers the right to sell, license, prevent others from using your invention/innovation/design or seek damages against a copycat or infringer.
It is also jurisdictional in nature which means that you can only benefit from patent protection where the industrial design is filed, and will not cover other countries where the industrial design was not filed.
What are the Requirements in Filing an Industrial Design?
1. A set of formal drawings showing perspective, front, back, top, bottom, left and right side views, and a description describing which view is each figure.
2. A priority document if priority is claimed (for international applications).
3. A signed Power of Attorney.
